State Nomination Requirements for Subclass 190 Visa (2025-26 Year)

190 visa is points based and allows skilled workers who are nominated by an Australian state or territory government to live and work in Australia as a permanent resident. In order to apply for the visa subclass 190, applicants must first successfully obtain a nomination from a state/ territory government. It is worth noting that besides the minimum requirements from the Department of Home Affairs, each state/ territory government has their own set of requirements that all applicants who want to be nominated must meet. Navigating the state/ territory requirements is often complicated.

Subclass 190 – State Nomination Basic Criteria

New South Wales


Basic requirements

  • be under 45 years of age.
  • Have a positive skill assessment in an occupation in the NSW Skilled Occupation Lists for 190 visa.
  • have at least a competent level of English. Citizen of the USA, UK, Canada, Republic of Ireland or New Zealand are not required to complete an English assessment.

NSW nomination is competitive due to a huge amounts of applications throughout the years. Therefore, you must increase your points as much as possible to maximise the chance of being nominated.

Residence

Onshore candidates 

  • Working in NSW in your nominated occupation; or
  • Residing in NSW and have continuously resided in NSW for a minimum period of six months (190 visa);

Offshore candidates 

  • Residing offshore and have continuously resided offshore for a minimum period of six months (190 visa).

Employment

You do not have to be currently working (or have previously worked) in NSW in your nominated (or closely related) occupation to be eligible for nomination.

Victoria


Basic requirements

  • be committed to living in Victoria

  • have at least Competent English
  • have a valid Skills Assessment in an occupation on the MLTSSL occupation list or STSOL occupation list
  • have achieved at least 65 points on the Expression of Interest (EOI) in SkillSelect
  • submit a Registration of Interest (ROI) and be selected
Onshore applicants:
  • Currently living in Victoria. No duration requirement.
  • Skilled employment – Required. You will be required to disclosure your current job details in Victoria. Skilled employment includes any role that is at skill levels 1, 2 or 3 in the relevant ANZSCO classification.
Offshore applicants:
  • Currently living offshore.
  • Employment in Victoria – Not compulsory.

For the subclass 491 visa in addition to applicants living in Victoria, applicants living offshore can apply, noting Victoria are currently prioritising health occupations for subclass 491 visa nomination.

Victoria’s 2024-25 state nominated skilled visa program will open in the coming weeks. More information will be published as it becomes available.

  • If you have a Spouse / Partner, they must be a resident in Canberra for at least six months or living overseas
Employment

Nominated occupation is on the latest ACT Critical Skills List. The highest ranked Matrix submissions per occupation will be invited to apply for ACT nomination. 

You have worked in Canberra for at least 26 weeks that you meet the overall hourly or earnings requirements as expressed below:

  1. A minimum of 30 hours per week in at least 26 out of the 30 weeks
  2. Genuine position based in Canberra. 
  • Self-employed
  1. Total (taxable) income is at least $1000 pw in at least 26 out of the 30 weeks

Western Australia

To be granted certain skilled migration visas to live and work in Western Australia, you must be nominated (invited) by an Australian state or territory through the State Nominated Migration Program.

Features of the 2024—25 program

  • no application fee;
  • equal invitation ranking for Interstate and Overseas candidates;
  • prioritised invitations for candidates with an occupation in a WA industry sector with critical demand for skilled workers;
  • reduced employment requirements for candidates invited through a WA building and construction industry sector occupation (as classified on the WA State nomination Occupation lists); and
  • additional employment contract arrangements for General Stream: WASMOL schedule

Streams

Your occupation will need to be eligible one of the following streams.

Minimum requirements – 190 visa nomination

  • Be under 45 years of age.
  • Have achieved at least 65 points on the Expression of Interest (EOI) in SkillSelect
  • Nominated occupation identified in your skills assessment must be listed on the WASMOL Schedule 1 occupation list
  • Have at least a competent level of English(e.g., IELTS – At least 6 fo​r each of the 4 components)
  • At least one year Australian or one year of overseas work experience in nominated (or closely related) occupation*
  • Full time employment contract in WA for a minimum of six months in the nominated (or closely related) occupation**

* You can only count work experience gained after you received your qualification, in paid employment, where you have worked at least 20 hours per week.

** Applicants invited through a WA building and construction industry sector occupation (as per the WA State nomination Occupation lists) do not need to have a contract of employment.

Northern Territory

Onshore applications for Northern Territory nomination under the General Skilled Migration program can now be lodged through the online application system. Offshore applications have been temporarily suspended.

Commitment to the Territory 

Committing to living and working in the Territory within your skilled occupation for at least three years upon the grant of your visa.

  • Successfully completed full-time NT-based tertiary course(s) for 2 years (4 semesters).
  • Lived in NT for ≥6 continuous months post last qualification completion on subclass 485 or associated bridging visa.
  • Demonstrated efforts for NT employment in nominated/closely related occupation through applications, professional memberships, industry feedback.

If you are nominated by the Tasmanian Government for this visa, you must live in Tasmania for two years after your nomination has been approved.

Subclass 190 – Skilled Nominated Visa Tasmania Pathways

190 – Tasmanian Skilled Employment (TSE) (2025-26)


Option 1 – TSE Priority Occupation option
  • You must have worked in Tasmania in a job closely related to your skills assessment.  (a role within the same ANZSCO 3-digit group as your skills assessment) for:
    • At least 9 months, or
    • 6 months if your skills assessment is for a teaching occupation (and you are working in a school) or health or allied health occupation.
  • Your skills assessment must be listed as a TSE Priority Occupation.
  • Your employment must meet any additional occupational caveats listed   for your occupation.
  • Your employment must have averaged at least 20 hours per week.
  • If self-employed or a contractor, you need:
    • A relevant skills assessment, and
    • 12 months of business activity in Tasmania.
Option 2 – Long-term employment – all occupations eligible for this pathway*
  • You must have worked in Tasmania in a role closely related to your skills assessment for at least 15 months immediately before applying  .
  • Your employment must meet any occupational caveats listed for your occupation.
  • If self-employed or a contractor, you need:
    • A relevant skills assessment, and
    • 12 months of business activity in Tasmania.
  • Your occupation must be on the Home Affairs skilled occupation list for subclass 190.
For both options
  • You must have worked an average of at least 20 hours per week over the six-month period immediately before you lodge your application.
  • You must currently be living in Tasmania and intend to continue living in Tasmania.
  • Your salary must be at least $57,000 per year or $28.85 per hour which excludes overtime, penalties, bonuses or casual loading.
  • There must be a genuine, ongoing need for your role including a minimum 12-month contract with at least three months remaining at the time you apply for nomination.
  • Your dependents must      not be   living in another Australian state or territory.    They must have moved and settled in Tasmania at least three months before applying for nomination.
  • Your employment must be closely related to your skills assessment. This means a role within the same ANZSCO 3-digit group as your skills assessment. Refer to additional information, exclusions and definitions for guidance.
  • You must genuinely intend to remain employed in Tasmania your current industry for at least two years after nomination.
  • If self-employed or a contractor, you need:
    • a relevant skills assessment, and
    • at least 12 months of business activity in Tasmania.
Employment and conditions
  • Your employer must be a well-established business that has been actively operating in Tasmania for the past 12 months (unless longer caveats apply to your occupation).
  • Your pay and conditions must be equal to or better than those for Australian citizens or permanent residents.
  • There must be a genuine, ongoing need for your role (including a minimum 12-month contract with at least three months remaining at the time you apply for nomination).
  • Casual employment is allowed but must comply with the Fair Work Ombudsman’s requirements.

Minimum Criteria
  • You must have completed a course with a Tasmanian tertiary institution registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) and received a completion letter.
  • You must have lived in Tasmania for at least two calendar years from the start of your course and throughout your studies.
  • Your course must have been:
    • Listed on CRICOS with a minimum duration of 92 weeks, and
    • AQF 5 (Diploma) or higher, or
    • at least Certificate III related to an OSCA Major Group 3 or Group 4 occupation
  • Study must have been full-time and on-site in Tasmania (at least 75% of a full-time load per semester; no online or distance learning).
  • VET courses must include at least 15 contact hours per week, unless the Australian Skills Quality Authority (ASQA ) specifies otherwise.
  • Credit transfers do not count toward full-time study hours.
  • PhD candidates who did not complete their undergraduate studies in Tasmania are eligible after living in Tasmania for two years and completing two years of their PhD.
  • You must currently live in Tasmania and intend to stay.

  • be working in a role with a Tasmanian-based employer that paid at least $57,000 per year or $28.85 per hour (excluding overtime, penalties, bonuses or casual loading), with at least 12 months of work in the last two years (minimum 20 hours/week).
  • be working in a role that paid at least the National Minimum Wage but less than $57,000 per year or $28.85 per hour, with at least 18 months of work in the last 3 years (minimum 20 hours/week).
  • have undertaken remote work for the immediate past 12 months while residing in Tasmania, for an employer or clients located outside the state, earning at least $57,000 per year or $28.85 per hour (excluding overtime, penalties, bonuses or casual loading).
  • You must have operated a business in Tasmania for at least the past two years, generating a minimum personal income equal to the Temporary Skilled Migration Income Threshold (currently $76,515), with the business also achieving a net profit of at least that amount.

  • You must currently be living in Tasmania and intend to continue living in Tasmania.
  • Your dependents must not be living in another Australian state or territory.
    • If self-employed or a contractor, you need:
      • a relevant skills assessment, and
      • at least 12 months of business activity in Tasmania.
  • There must be a genuine, ongoing need for your role (including a minimum 12-month contract with at least three months remaining at the time you apply for nomination).
  • If your job is not related to your skills assessment, you must have relevant qualifications or experience aligned with the Occupational Standards Classification for Australia (OSCA) definition for the role.
  • Your job does not need to match your skills assessment (unless you are  self-employed or a contractor.
  • You must genuinely intend to remain employed in Tasmania in your current industry for at least two years after nomination.
Salary less than $57,000

If you are working in a role that paid less than $57,000 per year or $28.85 per hour, but at least the National Minimum Wage :

  • You must have worked in Tasmania for at least 12 months
  • You must have worked an average 20 hours per week in the 12 months before you applied for nomination.

  • There must be a genuine, ongoing need for your position within the business (including a minimum 12-month contract with at least three months remaining at the time you apply for nomination). The contract may be casual, but must comply with the Fair Work Ombudsman’s National Employment Standards.

491 – Tasmanian Business Operator Pathway (TBO)(2025-26)


Minimum requirements
  • You must have established and operated a business in Tasmania for at least 12 months. The business must be solely owned or co-owned with your spouse.
  • Your business must still have been in profit after paying yourself a salary of at least 85 per cent of the Temporary Skilled Migration Income Threshold (currently $65,037)*. This income must come from genuine business activity and not be significantly supplemented by non-business sources such as personal savings, loans from family, or other external financial support.
  • You must demonstrate awareness of fair employment practices by completing key units from the Fair Work Ombudsman’s online learning centre.
  • Owners of massage therapy businesses must have a related skills assessment and a verifiable health fund provider number.

* Your Australian Taxation Office Business Income Statement and Personal Income Statement for the most recent financial year must demonstrate that your business operated at a net profit after your personal taxable income of $65,037 was deducted.
