Who can help with my visa application?

Two groups of people can legally give immigration assistance in Australia:

• Registered migration agents, who must hold the prescribed qualifications and show OMARA that they have sufficient knowledge of migration law and procedure, are people of integrity and are fit and proper to give immigration assistance.
• Australian lawyers with an unrestricted practising certificate, who since March 2021 can give immigration assistance without also being registered with OMARA. They are regulated by their state or territory legal regulator.

Agents can advise whether your visa application is likely to succeed, but they do not make visa decisions and cannot influence outcomes. Only the Department of Home Affairs (the Department) makes decisions about visa applications. It is against the law for anyone else in Australia to give you immigration assistance for a fee.

How to check your adviser

• Ask for their Migration Agent Registration Number (MARN) and check it on the OMARA online register of migration agents.
• Registered agents must give you a written agreement setting out the services and fees before they start work, so ask for a clear written quote.
• Remember that there are other costs too, such as the visa application charge, health checks and police certificates.
• Never let anyone give false information or documents to the Department on your behalf. You are responsible for everything in your application.
• Read the consumer guide and the agents’ Code of Conduct so you know what to expect.

Some agents work for community organisations and provide services for free, but most charge for their services. Each registered migration agent has different skills, so choose one that suits your situation. You might want help in your language, with a specific visa type such as a work, partner or student visa, or from an agent who understands your home country.
