Hiring a registered Australian immigration agent or lawyer* is not mandatory. Department of Home Affairs make clear that no special attention will be paid to a file as the result of using a registered migration agent. So why hire an experienced Australian registered migration agent instead of applying on your own?
The reality is, while some Australian immigration procedures and forms may appear simple, the legal considerations and ramifications that pertain are highly complex. Often here at VisaEnvoy we are contacted to do damage control after a situation has escalated. The consequences of not getting it right the first time range from costly delays to a negative decision, and most errors made by those who self-represent would have been avoided by an experienced and registered Australian immigration expert. When we are retained to provide a service, the client benefits from experienced and talented professionals who collaborate on every file and adhere to a strict code of conduct.
In the words of the Office of the Migration Agents Registration Authority:
A registered migration agent is qualified to help you with your visa application and can deal with the Department of Home Affairs (the Department) and other organisations for you.
You do not have to use an agent to lodge your visa application, but they can be very helpful, especially if your case is complex.
The help an agent can give you and the help an agent cannot give you is in this table.
| Can | Cannot |
| can explain which visa options are available to you, and recommend a suitable option | cannot guarantee your application will be successful |
| can prepare documents for your visa application | cannot help you get a visa if you do not meet the visa requirements |
| can lodge a well-prepared application with all required documents, which can make it easier and faster to get a decision from the Department | cannot guarantee faster processing of your application |
| can contact the Department or other organisations to discuss or ask questions about your application |
Not all agents are lawyers (legal practitioners), but some are. These agents are also qualified to give you legal advice and assistance, such as helping you prepare an application for a court to review a decision made about your visa application.
Lawyers*: Unlike most migration agencies, we have Australian lawyers who specialise in immigration law on staff which we believe allows us to provide a superior service. Immigration law is a highly specialised area of the law. Since March 2021, Australian lawyers who hold an unrestricted practising certificate can give immigration advice without also registering as migration agents, while everyone else who gives immigration assistance must be a registered migration agent regulated by the Office of the Migration Agents Registration Authority (OMARA). All of our advisers are registered migration agents, but many of them are not lawyers. Because we are regulated by OMARA, most of our Australian lawyers do not also hold practising certificates from the legal regulator, and we have chosen not to structure ourselves as an immigration law firm, so even when you are dealing with one of our lawyers, a solicitor-client relationship will not arise, as we will explain to you in detail when you engage us. Choosing not to be a migration law firm allows us to keep our costs down so that we charge substantially less for the same work than most migration law firms would. If your case does go to court, we can call on our networks of external lawyers to provide seamless representation.
Choosing the right registered Australian immigration agent is a decision worth getting right the first time. Office of the Migration Agents Registration Authority regulate agents by ensuring they meet appropriate standards of education, skill and professionalism. However, it is the client’s responsibility to properly analyse his or her options when selecting an agent.
