A copy of the Australian Privacy Principles may be obtained from the website of the Office of the Australian Information Commissioner.

All personal information collected is kept under strict confidence and handled in accordance with applicable privacy laws and the Migration Agents Code of Conduct.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, telephone numbers, educational background, employment background, family composition and other information relevant to assessing your suitability for visa, immigration and citizenship matters.

This Personal Information is obtained in many ways, including interviews, correspondence, by telephone, by email, via our websites, from media and publications, from other publicly available sources, from cookies, and from third parties. We do not guarantee the privacy policies or practices of authorised third parties or linked websites.

We collect your Personal Information for the primary purpose of providing migration and related professional services to you, providing information to our clients, and for related administrative, compliance and marketing purposes. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing or marketing communications at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

  • with your consent; or
  • where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Your Personal Information may be disclosed in a number of circumstances including the following:

  • to third parties where you consent to the use or disclosure;
  • where disclosure is required or authorised by law;
  • to government departments, tribunals, reviewing authorities, professional advisers, contractors, service providers or other third parties where reasonably necessary to provide our services or to meet legal and regulatory obligations.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse, interference and loss, and from unauthorised access, modification or disclosure.

We take reasonable steps to ensure that documents belonging or relating to a client or former client that are in our possession are kept securely.

Retention of Personal Information

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information, subject to our legal, regulatory, insurance and compliance obligations.

As a registered migration agent business, VisaEnvoy is required to maintain client files in accordance with the Migration Agents Code of Conduct. This means client files must be kept for 7 years after the last action on the file for the relevant client.

This retention requirement may apply even where a consultation, enquiry or engagement does not proceed, to the extent the information forms part of a client file or compliance record. This may include correspondence, forms, identification documents, CVs and other materials provided to us.

Where we are required to retain information, we may not be able to delete it on request until the applicable retention period has ended.

Access to your Personal Information

You may request access to the Personal Information we hold about you and request correction of that information, subject to certain exceptions. If you wish to access or correct your Personal Information, please contact us in writing.

VisaEnvoy will not charge any fee for your access request, but may charge a reasonable administrative fee for providing a copy of your Personal Information where permitted by law.
