Aged Parent visa (subclass 804)

The Australian Aged Parent visa allows older parents who are already on temporary visas to live in Australia permanently if their child is an Australian citizen, permanent resident or eligible New Zealand citizen who is settled in Australia.

There is currently a long queue in processing this particular visa where waiting times of up to 13 years before this visa is approved. Eligible aged parents may want to apply for the Contributory Aged Parent visa, however that visa will incur a larger application fee and an Assurance of Support bond will be required under this stream.

Aged Parent Visa Changes!

The Migration Amendment (Substituted Subclass 600 Visa Exemptions) Regulations 2025 introduces a key change for Aged Parent (Subclass 804), Contributory Aged Parent (Subclass 864), and Contributory Aged Parent (Subclass 884) visas.

What’s new?
Holders of a substituted Subclass 600 (Visitor) visa (granted via ministerial intervention under sections 351, 501J, or former section 417 of the Migration Act) can now apply for an Aged Parent visa – even if they don’t meet the age requirement!
Change applies retrospectively from 17 December 2024 , ensuring applicants who received a Substituted Subclass 600 visa remain eligible for the parent visa pathway.
Supports family reunification and aligns with human rights protections under international law.

Why does this matter?

  • Provides a pathway for parents to stay in Australia
  • Streamlines visa processing for affected families
  • Ensures consistency in applying ministerial discretion
